Love the Lullaby for Lawyers song... how appropriate!
This really stinks. I agree with you: who would have thought the term musicast was anything but generic? It's simply a concatenation of two common words, music and cast, no different than broadcast, simulcast, podcast, or any number of other terms.
I'd say call their bluff. Why are they represented by a Canadian law firm? It would be very expensive to fight a battle in the courts over this across borders. They apparently have no viable product, no website, and noone has heard of them. They can't want to spend a lot of money to defend what they aren't using, even if they do have the rights to it.
And it's not like you're getting rich off the use of their precious trademark - you're a podcaster after all!
I'd make them ante up and do more than just send a threat letter before I gave up. Then I'd change it to Miami Valley Music Podcast and thumb my nose at 'em!
I wonder if they are suing Yamaha over their use of the word? (Yamaha Musicast MCX-A10 Digital Audio Terminal) Or ARE they Yamaha?
Oh well, what's in a name, anyway?
